What are the Bankruptcy Time Restrictions?

There are no limits on the number of times one can file for bankruptcy in the United States; however, you must wait a certain number of years between each filing, depending on what chapter you previously filed for and which chapter you wish to file for now. The waiting periods between filings are:

  • Two years between back-to-back Chapter 13 filings
  • Four years between a Chapter 7 and Chapter 13 filing
  • Six years between Chapter 13 and Chapter 7
  • Eight year between consecutive Chapter 7 filings
